As someone said, surely sounds like an inside job…I mean, “we had
to leave them outside because we were doing some warehouse work…”
What a crock! And, if they were at the warehouse working, how come
they didn’t hear/see anything going on…what kind of security do
these guys have…sounds like bent security to me!!

Hard luck Pete…but on the brighter side, now you’ll have a

It’s unlikely that they were stolen to re-register…there are enough
eyes on these cars for that to be noticed. Either a joy ride, or they
were stolen for gasp parting out. My deepest sympathies.

Well, now that you know that the cars were in the open at the
shipper’s local agent, tort liability comes into play. In addition
to the bailment theory, pure negligence comes into play. The limits
in the bill of ladiong don’t apply, it is ACV!!!

As to the insured car, you have choices. Your insurance contract or
the tort claim v. the shipper’s agent.

It will take some csrteful reading of the policy and the shipping
documents.

I still hope you get them back.

How dumb could they get in leaving such attrations free of lock and
key.

I got to thinking. Were tehy prepared for shipping as to drained
fuel tanks, disconnected batteriese? And the keys? My favorite
question in theft investigstion was ‘‘may I see the keys?’’ Sure swa
some dumb looks that way.

The FHC was a non- runner Andrew so no chance it was joy
riders. Sadly, I also stuffed many of the bulky/delicate
relevant new parts into it for safe keeping/sorting. Exit
a new set of seat covers, foams, seat back fibres, chrome
rear screen trims, refurbed SUs etc. :frowning: I’m inclined to
think Eastern European thieves but have zero evidence
except there has been a recent influx and hiding/using the
cars with few questions would be easier there.

Carl, I am assuming that though outside, the cars were in
a locked compound with CCTV. I do not yet know this for
100% certain but even though I agreed verbally they had to
be inside would the locked compound constitute negligence?

Would the new spares (circa 2500 value) come from the car
specified value (which will be breached) or the shipped
goods insurance? If I claim for the road legal car from my
insurers can I claim more than half the agreed total for
the FHC? The cars were simply bundled in a total value and
not split out and being Series One I think the FHC will be
more expensive to replace than the Series 2 OTS.
